Terms of Service

These Terms govern your use of Eureka Academy at professorpascal.com (the "Service"), operated by Camila Paris, [LEGAL ADDRESS], Italy, VAT 05691140288 ("we", "us"). By creating an account you accept these Terms.
1. Who may use the Service
You must be at least 13 years old to hold an account. If you are under 16, a parent or legal guardian must provide consent before your account is activated, using the process described in our Privacy Policy. We do not knowingly permit accounts for children under 13, and we will delete any such account we discover.
If you are a parent or guardian consenting on behalf of a minor, you accept these Terms on their behalf and are responsible for their use of the Service.
2. What the Service is — and is not
Eureka Academy provides independently written lessons, practice questions, and an AI tutor ("Professor Pascal") for examination preparation.
We are not affiliated with, endorsed by, or approved by the College Board, the International Baccalaureate Organization, Cambridge International, Pearson Edexcel, or ACT, Inc. Our materials are our own interpretation of publicly published course frameworks.
We do not guarantee any examination result, score, grade, or admission outcome. Nothing on the Service is a promise of academic performance.
3. The AI tutor
Professor Pascal is an artificial intelligence system. Its responses are generated automatically and may be incomplete, outdated, or factually incorrect. You must verify anything that matters against your official course materials and your teacher. The AI tutor is not a substitute for qualified instruction, and it does not provide medical, psychological, legal, or financial advice.
We may change, limit, or suspend AI features, including the number of interactions available on any plan, where necessary to maintain service stability or manage cost. Where a change materially reduces what you have paid for, we will notify you and offer a pro-rata refund.
4. Academic integrity
You agree not to submit work generated by the Service as your own to any examination board, school, or academic institution. Examination boards impose severe penalties for this, including invalidation of scores. Responsibility for compliance with your institution's academic integrity rules rests entirely with you.
5. Acceptable use
You agree not to: share your account credentials; scrape, bulk-download, or resell our content; attempt to extract our question banks or system prompts; use the Service to harass others; upload unlawful content; or circumvent usage limits. We may suspend or terminate accounts that breach this section, with notice where reasonably possible.
6. Your content
You retain ownership of what you write into the Service. You grant us a limited licence to process it in order to operate the Service, including transmitting it to our AI provider to generate responses. We do not sell your content, and we do not use it to train third-party AI models.
7. Our content
All lessons, questions, explanations, illustrations, and the Professor Pascal character are our intellectual property and are licensed to you for personal, non-commercial study only.
8. Subscriptions, renewal, and cancellation
Paid plans renew automatically at the interval you selected until cancelled. The price and interval are shown before purchase. You may cancel at any time from account settings; cancellation takes effect at the end of the current paid period, and you keep access until then. We do not provide partial refunds for unused time within a period, except where required by law or under the withdrawal right described in our Refund Policy.
The Exam Season Pass is a single payment granting access for three months. It does not renew.
We may change prices with at least 30 days' notice before the change applies to your next renewal. If you do not accept the new price, cancel before it takes effect.
9. Availability
We aim to keep the Service available continuously but do not guarantee uninterrupted access. We may perform maintenance, and we may discontinue the Service with reasonable notice, in which case we will refund any prepaid period not yet used.
10. Liability
Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded — including the mandatory rights of consumers under Italian and European Union law.
Subject to that, our total liability to you for any claim is limited to the greater of (a) the amount you paid us in the twelve months before the claim, or (b) EUR 50. We are not liable for examination results, lost opportunities, or indirect or consequential loss.
11. Termination
You may delete your account at any time from settings. We may terminate for material breach of these Terms, giving notice and an opportunity to remedy where the breach is capable of remedy.
12. Changes to these Terms
We may update these Terms. For material changes we will notify registered users by email at least 30 days in advance. Continuing to use the Service after the change takes effect constitutes acceptance. If you do not accept, you may cancel and we will refund any unused prepaid period.
13. Governing law and disputes
These Terms are governed by Italian law, and the courts of Padova, Italy have jurisdiction.
This does not deprive you of consumer protection. If you are a consumer resident in the European Union, you retain the benefit of any mandatory protections of the law of your country of residence, and you may bring proceedings in the courts of that country. Consumers resident outside the EU retain any equivalent non-waivable rights under their local law.
